Welcome to Picturium.

Please read these Terms carefully before using the App, particularly the provisions concerning content rights, the risk of overwriting an original file during local editing, purchase and pricing, risk notices, limitations of liability, service changes, and dispute resolution.

By downloading, installing, purchasing, or using the App, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not download or use the App.

1. Scope

These Terms apply to the Picturium main application, its image viewing and editing features, related updates, and support services provided by the Developer.

Your software license is also subject to the Apple Standard End User License Agreement and applicable Apple Media Services Terms. These Terms primarily govern the App’s specific functionality and the relationship between you and the Developer.

2. Product Description

Picturium is an image viewing and editing tool for macOS. Its features may include:

• Opening and browsing common image formats, some camera RAW formats, and animated images such as GIF;
• Browsing images by folder and generating thumbnails;
• Zooming, panning, rotating, and viewing images;
• Cropping, rotating, freehand drawing, adding text annotations, and using a mosaic/pixelation tool to redact part of an image;
• Undoing and redoing edits;
• Saving edits back to the original file, or exporting to another supported image format;
• Sharing images through the system share feature; and
• Asking Finder to open the system “Get Info” window for a selected image.

Actual features, supported formats, interface, and availability are determined by the App’s actual functionality.

Picturium does not promise permanent compatibility with every camera model, image encoding, or third-party generated file.

3. Software License

Subject to your compliance with these Terms and applicable law, the Developer grants you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the App on compatible devices that you own or control for personal and lawful purposes.

Except where applicable law expressly permits or the Developer authorizes in writing, you may not:

• Copy, sell, rent, sublicense, distribute, or publicly make available the App;
• Reverse engineer, decompile, disassemble, or attempt to derive the App’s source code;
• Modify the App, create derivative works, or remove rights notices;
• Circumvent purchase verification, security restrictions, or other technical protections; or
• Use the App to interfere with devices, networks, or another person’s lawful use of services.

Open-source components included in the App remain subject to their respective licenses. Nothing in these Terms limits rights granted under an applicable open-source license.

4. Your Image Content

You retain the lawful rights you hold in content that you open, import, or edit. These Terms do not transfer ownership of your images to the Developer.

You must ensure that you are authorized to access, edit, save, and share the relevant images. You are responsible for their source, how you edit them, and any public display.

You may not use the App to:

• Infringe copyrights, trademarks, privacy rights, publicity rights, or other legal rights;
• Edit, redact, or distribute images for fraud, evidence tampering, or other unlawful purposes;
• Display or distribute unlawful, harmful, fraudulent, harassing, or malicious content; or
• Engage in activity that violates applicable law or a third-party agreement.

The App’s viewing, editing, and export capabilities do not mean that the Developer owns, reviews, recommends, or endorses any image content you choose to process.

5. Local Files, Editing, and Data

Picturium’s edits, thumbnail cache, and settings are primarily stored locally on your Mac.

You understand and agree that:

• Using “Save” to write an edit back to the original file overwrites its content, and this may be irreversible;
• The App may lose access if an original file is moved, renamed, deleted, or its permission becomes invalid;
• The thumbnail cache may be lost when you clear it, uninstall the App, the system cleans storage, a disk fails, or for other reasons; and
• You are responsible for keeping your own backup of an important or irreplaceable image before editing it.

Confirm your file selection and edits before a batch edit or an overwrite save.

6. System Permissions

To provide its features, the App may use:

• Read-write access to user-selected files and security-scoped bookmarks; and
• Apple Events (automation) permission, used only when you choose to ask Finder to open the system “Get Info” window.

You can manage these permissions in macOS System Settings. Disabling a permission may make the related feature unavailable.

7. Purchase and Pricing

Picturium is a one-time paid download and does not include in-app purchases or subscriptions. The actual price, currency, taxes, and any promotion are determined by the App Store product page.

Purchases, payment, and transaction records are processed by Apple through the App Store. You need a valid Apple Account and must comply with Apple’s payment and media-service terms. After purchase, you can redownload and reinstall the App on compatible devices signed in with the same Apple Account at no additional charge.

The Developer may adjust the App’s price, name, or purchase method in the future, without affecting a purchase you have already completed.

8. Privacy and Permissions

The Developer processes information relating to the App under the Picturium Privacy Policy.

The App does not request network access, and images you view or edit locally are not sent by the App to any server.

9. Intellectual Property

Except for user content and open-source components, the App’s code, design, interface, graphics, branding, text, and other materials are protected by rights held by the Developer or relevant rightsholders.

“Picturium” and related identifiers may be used only as expressly authorized by the Developer or permitted by applicable law.

If you provide suggestions or feedback, the Developer may use them to improve the App without identifying you and without violating applicable law. Providing general feedback does not give you ownership of the App.

10. App Updates and Service Changes

The Developer may update, modify, suspend, or discontinue parts of the App to improve functionality, correct defects, maintain security, support macOS changes, or comply with legal and platform requirements.

An update may change the interface, format compatibility, editing tools, or system requirements. Features may be unavailable because of device performance, system version, or changes to third-party file formats.

For a material change affecting your rights, the Developer will provide appropriate notice where reasonably practicable and legally required.

11. Risk Notices and Disclaimers

To the maximum extent permitted by applicable law, the App is provided “as is” and “as available.”

The Developer does not warrant that the App:

• Will be uninterrupted, error-free, or compatible with every device and image format;
• Can correctly open, edit, or save every file that uses a supported extension;
• Will be unaffected by system updates, permission changes, or hardware limits; or
• Can prevent data loss caused by accidental actions, an overwrite save, changes to source files, or cache cleanup.

This section does not exclude statutory warranties or consumer rights that applicable law does not permit to be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, the Developer is not liable for indirect, incidental, special, punitive, or consequential loss arising from use of or inability to use the App, editing results, data loss, or purchase services.

Where applicable law permits a cap on total liability, the Developer’s aggregate liability for related claims will not exceed the amount you paid to purchase the App.

Nothing in these Terms excludes or limits liability arising from the Developer’s intentional misconduct, gross negligence, infringement of personal rights, breach of mandatory consumer-protection obligations, or any other liability that cannot lawfully be excluded.

13. Indemnification

To the extent permitted by applicable law, if your conduct causes a third party to make a claim against the Developer, you are responsible for reasonable resulting losses, liabilities, and costs arising from:

• Unlawful use of the App;
• Infringement of a third party’s image content, privacy, intellectual-property, or other rights; or
• A material breach of these Terms.

This section does not require a consumer to waive any non-waivable right under applicable law.

14. Termination

You may stop using and uninstall the App at any time. If you materially violate these Terms or applicable law, your software license may terminate as permitted by law.

After termination, provisions concerning intellectual property, purchase transactions, limitations of liability, dispute resolution, and provisions that by their nature should survive will remain effective.

15. Minors

If you are under 18, you should review and accept these Terms under the guidance of a parent or legal guardian.

You must have the legal capacity and authorization required to make a purchase. Guardians should reasonably supervise a minor’s image sources and purchases.

16. Changes to These Terms

We may update these Terms to reflect changes in App functionality, applicable law, or platform requirements.

If a change materially affects your rights, we will provide reasonable and prominent notice where required by law. Revised Terms will identify updated “Last Updated” and “Effective Date” information.

If you disagree with the revised Terms, you may stop using the relevant features. Rights you have already lawfully acquired will not be unreasonably reduced.

17. Governing Law and Disputes

Without limiting any mandatory consumer-protection law applicable where you live, these Terms are governed by the laws of the People’s Republic of China.

If a dispute arises, the parties should first attempt to resolve it through the contact email. If no resolution is reached, either party may bring the dispute before a court with jurisdiction. This section does not restrict any mandatory venue or consumer remedy available under the law where you live.

If any provision is held invalid or unenforceable, the remaining provisions remain effective. A failure to enforce a right immediately does not waive that right.
